§ 1-2. Rules of construction.

  • In the construction of this Code and of all ordinances, the following rules shall be observed, unless such construction would be inconsistent with the manifest intent of the city council:

    City. The words "the city" or "this city" shall mean the City of Brewton, Alabama.

    City officials or officers. Whenever reference is made to officials, boards, commissions, departments, etc., by title only, i.e., "mayor," "city clerk," "planning commission," "chief of police," etc., they shall be deemed to refer to the officials, boards, commissions and departments of the City of Brewton.

    Clerk or treasurer. The term "city clerk" or "city treasurer" shall mean the clerk-treasurer of the City of Brewton.

    Computation of time. The time in which an act is to be done must be computed by excluding the first and including the last day; and if the last day is Sunday or a legal holiday, that shall be excluded.

    Council. The terms "council," "city council" or "governing body" shall mean the city council of the City of Brewton, Alabama.

    County. The word "county" or "this county" shall mean the County of Escambia, Alabama.

    Gender. A word importing one gender shall extend and be applied to the other genders.

    Month. The word "month" means a calendar month.

    Number. Words used in the singular include the plural, and the plural includes the singular.

    Oath. The word "oath" shall be construed to include an affirmation in all cases in which, by law, an affirmation may be substituted for an oath, and, in such cases, the words "swear" and "sworn" shall be equivalent to the words "affirm" and "affirmed."

    Or, and. "Or" may be read "and," and "and" may be read "or," if the sense requires it.

    Person. The word "person" shall extend and be applied to firms, partnerships, associations, organizations and bodies politic and corporate, or any combination thereof, as well as to individuals.

    Personal property. The words "personal property" include every species of property except real property.

    Preceding, following. The words "preceding" and "following" means next before and next after.

    Police jurisdiction. The words "police jurisdiction" mean the territory outside of the corporate limits of the city but within three (3) miles of such limits, but not including territory within the corporate limits of any other incorporated municipality.

    Property. The word "property" includes real and personal property.

    Real property. The words "real property" include land, tenements and hereditaments.

    Signature or subscription. The words "signature" and "subscription" include a mark when the person cannot write.

    State. The words "the state" or "this state" shall mean the State of Alabama.

    Street. The word "street" shall be construed to embrace streets, avenues, boulevards, roads, alleys, lanes, viaducts and all other public ways in the city and shall embrace all parts thereof within the designated right-of-way.

    Tense. Words used in the past or present tense include the future as well as the past and present.

    Written or in writing. The terms "written" and "in writing" shall be construed to include any representation of words, letters or figures, whether by printing or otherwise.

    Year. The word "year" means a calendar year.
